Man and Van Holland Park Terms and Conditions

These Terms and Conditions set out the basis on which Man and Van Holland Park provides domestic and commercial removal, man and van, and associated services within its service area in the United Kingdom. By making a booking, using our services, or allowing our staff access to your premises or goods, you agree to be bound by these Terms and Conditions.

If you do not agree with any part of these Terms and Conditions, you must not proceed with a booking or use our services.

Definitions

In these Terms and Conditions, the following words have the meanings given below:

Company means Man and Van Holland Park, the provider of the services described in these Terms and Conditions.

Customer means the individual, business, or organisation booking or receiving the services.

Services means removal, man and van, transport, packing, loading, unloading, or related services provided by the Company.

Goods means the items and property which the Company is requested to move, transport, handle, or store.

Service Area means the geographic areas within which the Company, at its discretion, offers services in the United Kingdom.

Scope of Services

The Company provides man and van and removal services for residential and commercial customers. Services may include the provision of one or more vehicles, one or more members of staff, packing or wrapping assistance if agreed, loading and unloading of Goods, and transport of Goods between agreed locations.

The exact scope of services, including collection and delivery addresses, number of staff, booking duration, and any additional services, will be agreed at the time of booking and confirmed by the Company.

Booking Process

All bookings must be made directly with the Company through the communication channels it makes available. The Customer is responsible for providing accurate and complete information about the nature and volume of the Goods, access conditions at all locations, parking arrangements, property type and floor levels, and any special handling requirements.

The Company may provide an estimate or quote based on the information supplied by the Customer. This estimate or quote is given in good faith but may be amended if the information provided is incomplete, inaccurate, or changes prior to the move, or if the actual work required differs significantly from what was originally described.

A booking is considered accepted only when the Company confirms it. The Company reserves the right to refuse any booking at its sole discretion.

Customer Responsibilities

The Customer must ensure the following:

That adequate and lawful parking is available for the Companys vehicle at all relevant locations, and that any necessary permits or authorisations are obtained in advance.

That the premises and access routes are safe, clear, and suitable for the handling and moving of Goods, including stairways, lifts, doorways, corridors, and external access.

That Goods are properly packed, labelled, and prepared for transport unless a packing service has been agreed with the Company.

That fragile, valuable, or delicate items are brought to the attention of the Company prior to the move, and that such items are suitably packed.

That any items which are restricted or prohibited by law are not included in the Goods.

That someone authorised by the Customer is present at collection and delivery addresses to provide access, directions, and to sign any documentation as required.

If the Customer fails to meet these responsibilities, the Company may at its discretion refuse to carry out part or all of the Services, or may impose additional charges to cover extra time, equipment, staff, or parking costs.

Quotations and Charges

Unless otherwise stated, quotations are based on the information supplied by the Customer and are subject to revision if that information changes. Charges are typically based on time, distance, the number of staff required, and the size of vehicle used. Additional factors such as heavy or awkward items, poor access, or extended waiting times may incur extra costs.

Quotations normally exclude the following unless expressly agreed:

Disassembly or reassembly of furniture or equipment.

Disconnecting or reconnecting appliances or electronic equipment.

Removal of doors, windows, or other fixtures at the property.

Handling of items that are exceptionally heavy, hazardous, or require specialist equipment.

The Company reserves the right to apply surcharges for work carried out outside standard hours, during weekends or public holidays, or in adverse weather or traffic conditions.

Payments

Payment terms will be confirmed at the time of booking. Depending on the nature of the booking, the Company may require a deposit, full payment in advance, or payment on completion of the Services.

The Customer must pay all charges in full in the manner specified by the Company. Time for payment is of the essence. If payment is not made when due, the Company may refuse to commence or continue with the Services, and may retain possession of Goods until payment is received in full.

The Company reserves the right to charge interest and administrative fees on overdue amounts in accordance with applicable UK law.

Cancellations and Amendments

The Customer may cancel or amend a booking by notifying the Company. The Company will confirm any accepted changes. The following cancellation provisions generally apply, unless otherwise agreed in writing:

If the Customer cancels more than a reasonable period in advance of the agreed start time, any deposit paid may be refundable at the Companys discretion, subject to administrative fees.

If the Customer cancels within a short notice period prior to the agreed start time, a cancellation fee may be charged, up to the full quoted price, to reflect the time reserved, staff allocated, and loss of opportunity to accept other work.

If the Customer wishes to amend the date, time, or scope of Services, the Company will endeavour to accommodate such changes but cannot guarantee availability. Changes may result in revised charges.

If the Company is unable to carry out the Services on the agreed date or time due to circumstances beyond its reasonable control, it will notify the Customer as soon as possible and offer an alternative date or appropriate solution. The Company will not be liable for any indirect or consequential loss resulting from such delay or rescheduling.

Access, Delays and Waiting Time

The Customer must ensure that the Company can start work at the agreed time and has adequate access to all properties involved. If the Company or its staff are prevented from starting or continuing the Services due to lack of access, delays in obtaining keys, incomplete packing, or any other cause within the Customers control, additional charges may be applied for waiting time, extended duration, or rescheduled visits.

The Company will take reasonable steps to arrive at the scheduled time, but times are estimates and may be affected by traffic, weather, or other factors. The Company is not liable for minor arrival delays, provided the Services are completed within a reasonable timeframe.

Exclusions and Prohibited Items

The Company does not carry or handle the following types of items, except by prior written agreement:

Explosive, flammable, or hazardous materials, including gas cylinders, fuel, paints, chemicals, or similar substances.

Illegal items or items obtained unlawfully.

Live animals or plants requiring special conditions.

Perishable goods that may deteriorate in transit.

Cash, jewellery, important documents, or other high value items beyond the Companys standard liability limits.

The Customer is responsible for ensuring that none of the above are included with the Goods. The Company may refuse to carry such items and will have no liability for loss, damage, or delay relating to them.

Packaging and Fragile Items

Unless a packing service has been separately agreed, the Customer is responsible for ensuring that all Goods are properly packed in suitable cartons or containers, sealed, and labelled as appropriate. Fragile and delicate items should be clearly marked and packed with adequate protective materials.

The Company will take reasonable care in handling all Goods, but will not be liable for damage arising from inadequate or improper packing carried out by the Customer or third parties.

Liability and Limits of Responsibility

The Company will exercise reasonable skill and care in providing the Services. However, its liability for loss of or damage to Goods or property is subject to the following limitations:

The Company is not liable for pre-existing damage, defects, or wear and tear.

The Company is not liable for damage arising from the inherent nature of the Goods, including fragile or unstable items, or from inadequate packing provided by the Customer.

The Company is not liable for minor cosmetic damage such as small scuffs or marks which may reasonably occur during normal removal activities, particularly where access is restricted.

The Company is not liable for loss, damage, or delay caused by circumstances beyond its reasonable control, including but not limited to severe weather, traffic incidents, road closures, strikes, or acts of third parties.

Where the Company is found liable for loss of or damage to Goods, its liability will generally be limited to the reasonable cost of repair or replacement, taking into account age, condition, and market value, and subject to any applicable overall cap on liability notified to the Customer.

The Company will not be liable for any indirect, consequential, or economic loss, including loss of profit, loss of business, or loss of enjoyment, arising out of or in connection with the Services.

Reporting Loss or Damage

The Customer must inspect Goods and premises as soon as reasonably possible after completion of the Services. Any visible loss or damage which the Customer believes was caused by the Company should be reported to the Company without delay and within a reasonable period.

The Customer should provide details including photos, descriptions of the items or areas affected, and any relevant supporting information. Failure to notify the Company within a reasonable timeframe may affect the ability to investigate and may limit or exclude any remedy.

Waste, Disposal, and Environmental Regulations

The Company operates in accordance with UK regulations relating to waste and environmental protection. The Company is not a general waste disposal service and may only remove and transport waste materials where this is lawful and has been expressly agreed in advance.

The Customer is responsible for ensuring that any items presented for removal comply with relevant regulations and are suitable for transport. Hazardous or regulated waste, including chemicals, asbestos, medical waste, or electrical items requiring specific disposal processes, will not be removed unless the Company has expressly agreed and holds any required authorisations.

Where the Service includes disposal or recycling, the Company will take reasonable steps to ensure that items are taken to appropriate facilities. The Customer remains responsible for any penalties, fines, or additional costs arising from the inclusion of prohibited or misdescribed waste materials.

Insurance

The Company maintains appropriate insurance cover for its vehicles and activities in accordance with UK requirements. The scope of that insurance may be subject to limitations and exclusions.

The Customer is strongly advised to retain their own home, contents, or business insurance to cover Goods in transit or during a move, and to check any applicable policy terms and limits before the moving date.

Subcontractors

The Company may, at its discretion, use subcontractors or third-party service providers to perform all or part of the Services. The Company will ensure that any such subcontractors are appropriately qualified for the tasks assigned. These Terms and Conditions will apply to Services carried out by subcontractors on behalf of the Company.

Complaints

If the Customer is dissatisfied with any aspect of the Services, they should contact the Company as soon as possible with full details of the issue. The Company will investigate the matter and seek to resolve it promptly and fairly. Any remedy offered will be at the Companys discretion, subject to these Terms and Conditions and applicable law.

Data Protection and Privacy

The Company collects and uses personal information only to the extent necessary to provide and manage its Services, including processing bookings, managing payments, and communicating with Customers. Personal information will be handled in accordance with applicable UK data protection laws.

Governing Law and Jurisdiction

These Terms and Conditions, and any dispute or claim arising out of or in connection with them or the Services, shall be governed by and construed in accordance with the laws of England and Wales.

The courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or their subject matter.

Severability

If any provision of these Terms and Conditions is found by a court or other competent authority to be invalid, unlawful, or unenforceable, that provision shall be severed from the remaining provisions, which shall continue to be valid and enforceable to the fullest extent permitted by law.

Amendments to These Terms

The Company reserves the right to update or amend these Terms and Conditions from time to time. Any such changes will take effect when published or otherwise communicated and will apply to all bookings made after that date. The Customer is advised to review the Terms and Conditions periodically.

By confirming a booking or using the Services of Man and Van Holland Park, the Customer acknowledges that they have read, understood, and agree to be bound by these Terms and Conditions.
